Agreement to Terms
By accessing or using ScotSites' services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services Overview
ScotSites provides professional web design and development services specifically for trade businesses in Scotland. Our services include:
- Website design and development
- Website hosting and maintenance
- SEO optimization
- Content creation and management
- Ongoing technical support
Service Agreement
Project Scope
Each project begins with a detailed proposal outlining:
- Deliverables and specifications
- Timeline and milestones
- Pricing and payment terms
- Number of revision rounds included
Client Responsibilities
To ensure timely project completion, you agree to:
- Provide all required content, materials, and information in a timely manner
- Respond to our requests for feedback within agreed timeframes
- Ensure all content provided is accurate and legally compliant
- Have the necessary rights to any images, logos, or content you provide
- Make timely payments according to the agreed schedule
Payment Terms
Project Payments
For website design projects:
- Deposit: 50% deposit required before work begins
- Final Payment: 50% due upon project completion and before launch
- Alternative payment schedules may be arranged for larger projects
Monthly Packages
For hosting and maintenance packages:
- Billed monthly in advance
- Payments due on the 1st of each month
- 30 days notice required for cancellation
Late Payments
Late payments may result in:
- Work being paused until payment is received
- Website hosting being suspended after 14 days
- Late payment fees of 5% per month on outstanding balances
Revisions and Changes
Included Revisions
During the initial build process, we include:
- Up to 3 rounds of design revisions
- Minor content updates and corrections
- Bug fixes and functionality issues
Additional Changes
After website launch or exceeding included revisions:
- Additional changes billed at our hourly rate (£75/hour)
- Or covered under monthly maintenance packages
- Major redesigns require a new project agreement
Timeline and Delivery
Project timelines are estimates and depend on:
- Timely provision of content and feedback from you
- Complexity and scope of the project
- Any changes or additions to the original scope
Delays caused by late content provision or feedback may extend the delivery date. We will keep you informed of any timeline changes.
Intellectual Property
Your Content
You retain all rights to content you provide (text, images, logos, etc.).
Our Work
Upon full payment:
- You own the design and content of your website
- You receive a license to use any custom code we develop
- We retain the right to use third-party components and frameworks
- We retain the right to showcase your website in our portfolio (unless you request otherwise)
Third-Party Assets
Some components may use third-party resources:
- Open-source frameworks and libraries
- Stock photos (licensed separately)
- Premium plugins or themes (licensed to you)
Website Hosting
For websites we host:
- We use reliable hosting infrastructure (Vercel)
- We perform regular backups of your website
- We aim for 99.9% uptime (not guaranteed)
- You can migrate your website at any time (export provided)
Support and Maintenance
Post-Launch Support
After your website launches:
- 90 days of free email support for bug fixes
- Training on how to update content (if applicable)
- Documentation for your website features
Ongoing Maintenance
Optional monthly packages include:
- Software updates and security patches
- Content updates (up to agreed hours)
- Performance monitoring
- Priority support
Warranties and Disclaimers
Our Warranty
We warrant that:
- Our work will be performed professionally and competently
- Your website will function as specified in the project agreement
- We will fix any defects reported within 90 days of launch at no charge
Disclaimers
We cannot guarantee:
- Specific search engine rankings or traffic levels
- Increased sales or customer inquiries
- 100% uptime or zero downtime
- Compatibility with all future browser versions or devices
Limitation of Liability
To the fullest extent permitted by Scottish law:
- Our total liability is limited to the amount you paid for our services
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for losses caused by factors beyond our reasonable control
- You agree to indemnify us against claims arising from content you provide
Termination
By You
You may terminate services by:
- Providing 30 days written notice for monthly packages
- Following our Refund Policy for project work
By Us
We may terminate or suspend services if:
- Payments are more than 30 days overdue
- You breach these terms
- Your content violates laws or our policies
- Continuing the relationship becomes impractical
Confidentiality
Both parties agree to:
- Keep confidential information private
- Use confidential information only for project purposes
- Return or destroy confidential materials upon request
Force Majeure
Neither party will be liable for delays or failures caused by circumstances beyond reasonable control, including acts of nature, war, strikes, pandemics, or government actions.
Governing Law
These terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email. Continued use of our services after changes constitutes acceptance of the new terms.
Severability
If any provision of these terms is found unenforceable, the remaining provisions will continue in full effect.
Entire Agreement
These terms, together with your project proposal and any other written agreements, constitute the entire agreement between you and ScotSites.
